Fidelity Home Group Email Policy

It’s important to Fidelity Home Group to provide various means of communicating with our customers this includes but isn’t limited to email, text message, telephone, voicemail, online chat, instant message, blog comments, social media, fax machine, and regular mail. Because of this, we also think it’s equally important to provide you with terms and conditions for these methods of communication.

Email you receive from Fidelity Home Group is conditioned upon your agreement to the following terms:

Emails

Email is a way that we communicate to you but at times it can be brief and informal. Due to this, emails may not accurately represent the entire matter in relation to getting a mortgage, or the mortgage process. In many instances, communications about a particular situation or loan example are exchanged through various channels like email, telephone calls, voicemails, texts, faxes, letters, postcards, instant messages, social media responses and engagement, and in person. Sometimes multiple forms of communication may be exchanged through multiple channels at the same time. Accordingly, an email, by itself, may not accurately reflect the complete communication or intent of Fidelity Home Group as it can be taken out of context. All official home loan matters should be subsequently confirmed in signed writings and documents. Also, the receipt of an email from Fidelity Home Group may not put us on notice of any matters/issues contained within that particular, email.

E-Sign Disclaimer

Unless there is explicit and specific language and disclosures to the contrary, Emails from Fidelity Home Group do not contain or constitute an electronic signature, even if the sender’s name appears in the email. Email communications are not intended to be construed against the Company as an interest rate lock, an unconditional loan commitment, an unconditional loan approval, unconditional qualification, or any unconditional offer or agreement to lend. Such documents and agreements are generally sent to clients in formal signed writings from the Company.

Confidential Information

Emails (and all attachments) sent by Fidelity Home Group team members and representatives are confidential and should be reviewed to only the individual to whom they are addressed and intended. Any unauthorized use, disclosure, reproduction, or distribution is prohibited. If you received an email in error or if it was improperly forwarded to you, the information contained in the Email should remain confidential and does not authorize you to use or share any confidential information. Notify the sender immediately via telephone or email and delete the original. Treat these emails marked as “confidential” and stay in compliance with privacy laws (including but not limited to the Gramm-Leach-Bliley Act). Ensure confidential information is not disclosed or used by others. By accepting the confidential information provided by Fidelity Home Group, you agree to hold Fidelity Home Group harmless against any and all claims, losses, liabilities, or expenses that Fidelity Home Group could incur as a result of the unauthorized use or disclosure of confidential information due to your acts or omissions.

Privileged Information

Emails exchanged with or involving our legal and compliance teams may contain privileged information subject to the attorney/client privilege and/or the attorney/work product privilege. Such privileged information will not be waived if you receive an Email in error or if it was improperly forwarded to you. If you are not the intended recipient of privileged information, please notify the sender immediately by telephone or Email, and delete or destroy the original and any copies. Unauthorized use, disclosure, reproduction, or distribution of confidential or privileged information is prohibited.

Filters and Time Sensitive Instructions

Please do not use email to communicate time-sensitive instructions or official company matters; they may not be received or reviewed by the appropriate Fidelity Home Group team member or representative in a timely manner. All emails are processed through both virus and spam filters which may delay/reject the delivery of an email or emails. Urgent matters should always be communicated directly with the person of concern by telephone, and also confirmed in writing with the appropriate person by fax or Email. Fidelity Home Group reserves the right to block any email source it sees as inappropriate.

Business Purposes

Emails from Fidelity Home Group are to be used only for conducting mortgage business with our company. Vendors, suppliers, clients and others receiving Email from team members at Fidelity Home Group may not use any Email address or team member’s contact information (or any other person’s Email address appearing on or in a Fidelity Home Group email) for any purpose other than corresponding with Fidelity Home Group for lawful and legitimate business purposes relating to the business of our company. The receipt of an email is not Fidelity Home Group’s consent, nor an individual Fidelity Home Group team member’s consent, for you to use our Fidelity Home Group email addresses or contact information for direct marketing purposes or for transfers of data to third-parties, and such use is prohibited.

Communications Monitoring

All emails sent to or from Fidelity Home Group’s team members may be forwarded, monitored, and/or reviewed by others within our company other than the designated recipient/sender with or without notice to the designated recipient/sender. We may also record or monitor other forms of communications you have with us via the website, instant message, social media, chat, email, and telephone. By using these communication methods you are consenting to the recording or monitoring of the same.

Unsecure Email Transmissions

Regular Email is typically sent via the Internet which is an open network. While certain designated areas within our website and webpages employ technologies to secure your data and the transmissions between you and Fidelity Home Group, general email uses the Internet which is an open system and we cannot provide absolute assurances that all email transmissions (sent or received) are secure, incomplete or virus free and/or that they won’t be lost, mis-delivered, destroyed, delayed, or intercepted/decrypted by others. Fidelity Home Group advises against emailing time-sensitive or personal identifiable information over Email and disclaims all liability with regard to emails (in addition to the content within the email) if they are lost, destroyed, delayed, incomplete, mis-delivered, intercepted/decrypted or otherwise.

Viruses

Although Fidelity Home Group believes email to be free of any virus or other defects that could cause harm to your computer system, please note that computer viruses can still be transmitted through attachments, content, and links. It is the recipient’s responsibility to make sure that any Email opened on their computer system is free of any harmful viruses. Fidelity Home Group is not liable for loss or damage due to the use, transmission, or storage of our emails. If any team member at Fidelity Home Group replies or an email, the contents may have been produced by someone other than a Fidelity Home Group representative and we assume no liability. Fidelity Home Group revokes any warranty or representation that emails from our company are free of viruses and/or are error free. The use of email to cause harm by way of a virus, disabling code, or otherwise that interferes with Fidelity Home Group email transmissions, phone system, or computer networks is prohibited and against the law; all violators will be prosecuted.

Email Content

Fidelity Home Group team members and representatives are strictly prohibited from using email to send, defamatory, discriminatory, harassing, or offensive statements/materials/graphics, or anything that infringe the copyrights or legal rights of others via email. These communications are against Fidelity Home Group policy and outside the scope of the Fidelity Home Group employment of individual team members and representatives. We do not accept any liability in respect of these communications, and the individual team member or representative will be responsible and personally liable for any damages or other liability arising. The use of Fidelity Home Group’s Email systems for purposes of sending defamatory, discriminatory, harassing, or offensive to any Fidelity Home Group team members or representatives is prohibited and unlawful; violators will be prosecuted. Use of Fidelity Home Group’s Email systems for purposes of t soliciting our Fidelity Home Group team members and representatives to breach their employment agreements or to interfere with their employment status with Fidelity Home Group is also prohibited.

All Rights Reserved

Fidelity Home Group reserves all rights to our content in our emails in addition to this email policy. No part of Fidelity Home Group’s emails or policy can be used without the written permission of a representative of Fidelity Home Group’s Compliance Officer. 

IRS

Fidelity Home Group disclaims any U.S. federal tax advice contained in or provided through email (including any attachments). Any reliance upon such tax advice cannot be used, for the purpose of (i) avoiding penalties under the Internal Revenue Code or (ii) promoting, marketing or recommending to any other party any transaction or matter that is addressed, contained in or provided through email (including any attachments).

Negligence

Fidelity Home Group disclaims all responsibility, including but not limited to negligence or negligent misstatements for accuracy and reliability of data contained in or provided through Email. Fidelity Home Group makes no warranties, with respect to such data.

Governing Law

In receiving and opening emails from Fidelity Home Group, you agree to the terms and conditions provided to you by Fidelity Home Group. Any disputes pertaining to Fidelity Home Group emails will be governed by and in accordance with the laws of the State of Florida, without giving effect to conflicts of law. You also agree any actions at law or in equity relating to Fidelity Home Group’s terms and conditions may only be filed in the state or federal courts located in Florida.

Opt-outs

Emails from Fidelity Home Group may constitute a marketing advertisement or solicitation under U.S. law, if its primary purpose is to market a commercial product or service. If you do not wish to receive marketing messages from Fidelity Home Group at a specific email address, specify your preference by opting out by click on the link provided at the bottom of the email, or by calling insert phone number or another way to opt out.

Fidelity Home Group mobile/text message alerts provide a secure and easy way to access interest rates and receive promotional and mortgage information from almost any mobile device or cell phone.

Signing Up for Mobile Alerts

You can sign up for Fidelity Home Group mobile/text message alerts by texting YES. By signing up and choosing your subscription, you will receive 5 messages per month.

You can sign up for daily messages by texting YES. By signing up and choosing your subscription, you will receive 25 messages per month.

You can sign up for weekly messages by texting YES. By signing up and choosing your subscription, you will receive 10 messages per month.

Fidelity Home Group mobile/text message alerts are not considered mobile spam. The service is a recurring message program.

You will not be charged when you send a text message or when you receive a response. However, message and data rates may apply depending on the wireless plan you have with your carrier.

Participating Carriers

AT&T, T-Mobile®, Verizon Wireless, Sprint, Boost, Alltel, U.S. Cellular, Cellular One, MetroPCS, InterOp, Cellular Com, C Spire Wireless, Cricket, and Virgin Mobile.

Opt-out of Messages

If you wish to stop receiving text messages from us, you may unsubscribe by texting the word STOP or by calling insert phone number. Once your telephone number is removed from the Fidelity Home Group system, you will receive a confirmation message and no further messages will be sent to your cell phone or mobile device.

Can I Opt Back In?

You can start receiving Fidelity Home Group text messages again (after opting out) by texting YES.

Need Help or Additional Information?

You may text the word HELP for more information.

Fidelity Home Group reserves the right to block any mobile telephone number and disable Fidelity Home Group text/mobile messaging without any notice.

By using Fidelity Home Group’s text/mobile messaging service, you agree to the terms stated in this document and by the State of Florida, without giving effect to conflicts of law. You also agree that any action at law from your use of Fidelity Home Group text/mobile messaging or relating to these terms and conditions may only be filed only in the state or federal courts located in Florida. Consent to these terms is not required as a condition to purchase or refinance a mortgage with Fidelity Home Group.
